Parkin secures acquittal in rare squatters rights fraud prosecution

Christopher Parkin (leading Bella Gooch of 6 St James Hall) has secured an acquittal in a rare prosecution for fraud over the obtaining of land through adverse possession or “squatters rights”.

Peter Colquhoun was acquitted after the Court accepted the argument that the Crown had failed to establish beyond reasonable doubt that he was part of a joint criminal enterprise.

The reasons for verdict of Abadee DCJ, sitting without a jury, can be found here. The case has since been reported on by The Sydney Morning Herald.

Christopher specialises in fraud and white collar crime and accepts briefs in trials, appeals and sentences.
