Christopher Parkin and David Helvadjian successful in defamation limitation appeal

153 Phillip members Christopher Parkin and David Helvadjian have successfully obtained an extension to the limitation period of nearly three years for their client to commence defamation proceedings against the Nine Network.

The appeal, heard by the Full Federal Court, concerned the operation of section 56A of the Limitation Act 1969 (NSW) and the proper application of the principles in Joukhador v Network Ten Pty Ltd [2021] FCAFC 37.

The Full Court allowed the appeal, overturning the primary judge’s decision and granting the extension with costs.
