Albaf v NSW Education Standards Authority [2026] NSWSC 880

In Albaf v NSW Education Standards Authority [2026] NSWSC 880 the Plaintiff successfully sought judicial review of a determination by the Defendant that he was not a fit and proper person to be a school principal. The Defendant's determination arose out of a series of social media posts made by the Plaintiff. The Court found the Plaintiff had been denied procedural fairness by the Defendant, and also found the Defendant's decision was legally unreasonable. Tom Brennan SC from 13 Wentworth Chambers led Paul Farrell from 153 Phillip Barrister for the successful Plaintiff. The full decision is available here.
